The contract between you and Fatality Servers when you buy hosting from us. It covers how accounts work, how we bill you, what we promise on service levels, what can get a server suspended, and how disputes get resolved. Written in plain English, no lawyer filler.
These Terms of Use (the "Terms") are a legally binding agreement between you (the "Customer", "you", "your") and Fatality Servers ("Fatality Servers", "we", "us", "our"). They govern your access to and use of our website, customer panel, hosting products, and any related services (collectively, the "Services").
By creating an account, buying a product, or continuing to use the Services after these Terms take effect, you confirm that you have read, understood, and agreed to them. If you don't agree, don't use the Services.
These Terms sit alongside our Privacy Policy, Refund Policy, and Acceptable Usage Policy. Together, those four documents form the full agreement. Where they conflict, the more specific document wins (e.g. the Refund Policy controls refunds).
You must be at least 16 years old to create an account, and at least 18 years old (or the legal age of majority where you live, whichever is higher) to enter into a paid contract. If you're buying on behalf of a business, you confirm you have authority to bind that business to these Terms.
We do not sell to users subject to comprehensive economic sanctions (including, without limitation, the UK's HM Treasury consolidated list, the EU's consolidated financial sanctions list, OFAC's SDN list) or to users in countries where we are prohibited from exporting hosting services.

You may only hold one active customer account at a time. If you need multiple billing relationships (e.g. personal + company), contact us and we'll help set them up correctly. Creating duplicate accounts to circumvent suspensions, promotions, or refund limits is a breach of these Terms.
Fatality Servers provides:
Specific features, limits, and pricing for each product are described on the relevant product page and in the customer panel. The Services are offered as "platform access" โ not as a license to any specific hardware unit.
We may offer features marked "beta", "preview", or "early access" from time to time. Those features:
Prices are shown on each product page and at checkout, in the currency indicated. Prices are exclusive of VAT / GST / sales tax unless stated otherwise; applicable taxes are added at checkout based on your billing address.
We accept major credit and debit cards, PayPal, bank transfer (for annual plans and dedicated servers), and selected cryptocurrencies where available. Payment is processed by our payment processors (Stripe, PayPal, and select regional providers). Full card details are handled by the processor โ not by us.
All fees are due in advance of the billing period. Failed payments trigger retry attempts for up to 5 days, after which the service may be suspended (see Suspension).
You are responsible for any taxes or duties applicable in your jurisdiction that we do not collect. Where we are required to withhold taxes, we will do so and credit the net to your account.
If you believe a charge is incorrect, notify us within 60 days of the charge date. We'll investigate and, if the charge is in error, issue a refund or credit promptly. Charges not disputed within that window are deemed accepted.
Before initiating a chargeback with your card issuer, please contact us โ most issues can be resolved in one email. Unjustified chargebacks (after we've offered a refund, or for services already fully rendered) may result in account suspension and a chargeback-handling fee equal to the amount your card network charges us (typically $15-25 USD per chargeback).
Subscriptions renew automatically at the end of each billing period at the then-current list price, unless cancelled. You will receive a renewal reminder at least 7 days before each renewal for monthly plans, and at least 30 days before renewal for annual plans.
You can cancel any subscription at any time from the customer panel. Cancellation takes effect at the end of the current paid period โ you keep the service you've already paid for, and we stop charging you.
Cancellation does not entitle you to a refund for the unused portion of the current period, except where required by applicable consumer law or by the Refund Policy.
After your service ends, your server data (worlds, configs, logs) is retained for 14 days. You can request a data export during this window. After 14 days, the data is permanently deleted from our primary and backup systems within 30 days.
We commit to a 99.9% monthly network uptime target for managed game servers, VPS, and dedicated servers. Uptime is measured at our network edge โ we're responsible for everything from the public IP to the server, not for issues caused by:
If we miss the 99.9% target in a given calendar month, you may claim a service credit equal to 5% of that month's fees per 0.1% below target, capped at 50% of monthly fees. Service credits are the exclusive remedy for missed SLAs and must be claimed within 30 days via a support ticket.
You retain all rights to the content you upload to or create on our Services โ worlds, saves, configs, plugins you author, mod packs you assemble, user-generated content in your communities. We do not claim ownership of any of it.
You grant us a limited, non-exclusive licence to host, copy, transmit, back up, and otherwise handle your content solely to the extent necessary to provide the Services. This licence ends when your service ends.
You are solely responsible for:
We take automated backups as part of most managed plans. Those backups are a best-effort convenience, not an insurance policy. You should maintain your own off-site backups of anything you can't afford to lose.
Your use of the Services is governed by our Acceptable Usage Policy (the "AUP"). In short: no illegal content, no network abuse, no copyright infringement, no disruption of other customers, no use that materially threatens the integrity of the platform. Review the AUP for the specifics โ violations can result in suspension or termination without refund.
We may suspend your service, without prior notice, if we reasonably believe:
Where practical, we will give you notice and a reasonable opportunity to cure before suspending. For immediate-harm cases, we may act first and notify you after.
You may terminate for convenience at any time via cancellation (see ยง5.2).
We may terminate the agreement and delete your account:
To the fullest extent permitted by applicable law, the Services are provided on an "AS IS" and "AS AVAILABLE" basis, with all faults and without warranty of any kind. We expressly disclaim all warranties, whether express, implied, statutory, or otherwise, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.
We do not warrant that the Services will be uninterrupted, error-free, secure against all attacks, or compatible with every third-party game, mod, plugin, or framework. No advice or information obtained from us, whether oral or written, creates any warranty not expressly stated in these Terms.
To the fullest extent permitted by applicable law:
These limitations apply even if a limited remedy fails of its essential purpose. They do not apply to liability that cannot be limited by applicable law (e.g. fraud, wilful misconduct, death or personal injury caused by negligence, or breaches of mandatory consumer-protection statutes).
You will indemnify, defend, and hold harmless Fatality Servers and its officers, directors, employees, and agents from and against any and all third-party claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:
We will promptly notify you of any claim, allow you to control the defence (with counsel reasonably acceptable to us), and reasonably cooperate at your expense.
Our Services let you run third-party game servers, plugins, mods, and frameworks. Those are governed by their own licences (e.g. Mojang EULA, Valve SteamCMD terms, Cfx.re Terms of Service, plugin authors' licences). You are responsible for complying with each of them. We are not party to those licences and make no representations about them.

These Terms are governed by the laws of the jurisdiction in which Fatality Servers is established. For consumers in the UK, EU, or EEA, nothing in this clause removes the mandatory protections of your local consumer-protection law.
Before starting any formal legal proceedings, both parties agree to first try in good faith to resolve the dispute through support or a direct escalation to management (email [email protected]). Most disputes are resolved at this stage.
If informal resolution fails, the courts of Fatality Servers' established jurisdiction will have non-exclusive jurisdiction, except where applicable consumer-protection law gives you the right to bring a claim in your home courts.
Neither party is liable for failure or delay caused by events beyond its reasonable control, including but not limited to war, terrorism, civil unrest, labour disputes, government action, pandemic, natural disaster, utility or internet-backbone failure, or third-party service outages.
